Once again pm.com steps up to support its members...or not?
« on: February 22, 2015, 09:01:02 AM »
I have been ranting over at pm.com about a Russian member Hymak
who has been posting my KoolWheelz models on a Russian Paper Model site known for distributing pirated material.
Its an open forum where members can post just about anythng, and the majority of what they post is copied files
of paper models...printed and digital kits, that have been recopied, repackaged and reshared through various file hosts.

Anyway, this guy Hymak is a long standing member over at pm.com, and its obvious that where he gets his material.
(One of my models was reposted using a photo pulled from the pm.com forum, and the model iteself was an exclusive
version advertised at pm.com)

He isn't an active member at pm.com (0 posts) but he did respond with some private messages to me when I first posted
my rant about the piracy.
His claim was that he was helping me...promoting my site by posting my models. He claimed that he made a point of not
removing my name from the models.

Anyway, as I said, I have been ranting about this guy assuming that the community and forum (pm.com)
would stand behind me. Show me some support since that what I try to do.
But once again, I am left holding the pistol...with no backup in sight.

Today I received a PM  asking for a cease and desist....? what, for defending myself again?

Just like the last time when a pm.com member attacks me, and I get threatened with time-out for defending myself?!
and the guy gets to to stay (until he personally attacks a moderator)!?

Hymak has ...is...commiting actions against a member of that community.
I would stand behind a respected member of that community.
The pm.com forum should do the same for me.
Obviously I am not a respected member of that community.

And then they delete my thread?
A few years back I begged for all those lies and slander that Zathros posted to be removed.
They weren't. They're still there to this day.
But my complaints about Hymak is removed.

So the rule at pm.com forum is
"go away and fight your own battles.
Don't bother us with it.
But make sure we get your free models."

Bunch of bullshit.

I just made a post over there about the removal of the thread.  I wonder how long it will remain up

And the thread is back up.

according to webdude (Rick) the thread was moved to the "anti-piracy" area.

apparently the anti-piracy area is not a public area...members only.
LOL
I am not a member.
...what a pointless thing, having an anti-piracy area that nobody can see.

anyway, because I could not access the area, the thread has put back where it was.
But I have been warned that if the name-calling continues, admin will step in.

I have nothing else to do, but name call. [thief, pirate, little shit]
At this point I have run out of options and that forum is my only connection with the guy.
But once again pm.com has no interest in getting involved.
If it was this forum, and a member posted all the same evidence about Hymak, I can honestly
say that I would show support for a long time contributing member and probably ban Hymak.

I also owe you an apology.  I was talking to Dad on the phone yesterday about the thread and the issue, and I knew I needed to post something, but I just couldn't wrap my head around what I should post that would be helpful.  Dad and I threw some ideas around, but left it with 'I think I need to think about this some more'.  And I didn't come up with anything, nor did he, though we talked about it later last night again.

Hopefully I was able to help today

Evidently I am not a Member, either.  Banning Hymak and his ip would seem to be logical, and I don't understand why they don't

okay, just read your post

I guess you already understand what happened (didn't need my explanation in the last post)

I thank you for your comments.
It is refreshing to see someone show some support.

"I thought we were a group that stood up against piracy, at least the most blatant sort, which this is."
This is a great sentence.

But I will admit...many people don't agree that this is anything like "blatant piracy"
And I get their point.

My issue is specifically about making a copy of the file to upload to a new file server
and then posting links to that file, basically circumventing the need to go to my site.
I see the problem with that (as it applies to me) but others don't.
They see a freely shared model being freely shared.
Its not as if my name or contact info was removed from the model.
Its all still there, the model is untouched.

But the bottom line is...hymak ignored the warnings on my website. He ignored the warnings
on the models. He ignored any warnings he may have read on the forums. He knows what he
is doing. He copied the file, and reposted it with any declaration to me or asking for permission.

lol I am typing as you are still posting.
sorry if I can't keep up!

I have submitted DMCA reports to more file hosters today and slowly I am getting the files taken down.
I also updated the warning on my site.

Policy...if you want to promote KoolWheelz models on another website...you have permission to do so.
Restrictions:
1. Posting images of the models...you are allowed to copy and paste anything from my site or ask me for images.
2. Posting only links to the model download pages on my website.

I want people to download the model from my website. Thats all I ask.

Thank you Dave.
I do appreciate the comments and support.
I agree with you.

...
Followup report on the state of pirated models and my efforts to remove them...

(wow, that all sounded very snooty)

I found five more Kool Wheelz models last night (posted on that Russian forum)
all by Hymak.

Each model had two file links (not mine) ...Turbobit.net and Depositfiles.com

I submitted the dmca report (using the proper form) to both file host for all five files.
Just got a notice, only one hour later, from Turbobit..."all files deleted as per your request".

Hoepfully Depositfiles follows suit.

I did get some of the first goup of models deleted through Rapidgator and Depositfiles
before they were deleted on the Russian forum.

...
Here is a template you can use for making DMCA reports.
If you do not use this format, your requests will be ignored.
File hosts demand this method.

Theres another name on that russian forum that I think I recognize...squirrelfish
He is responsible for a shitload of pirated model, including just recently, Uhu's Automata Robot model.

I was going to check to see if squirrelfish is also a member at pm.com
But it appears the "Members List" has disappeared.

I asked a mod about it but got no response.
I just asked Turner about it.

You may be correct in your assumption that "we may have found the source of much pirate material from pm.com"

Actually the Members List disappeared at least over a week ago.  I mentioned somewhere that I was wanting to work on a calendar of model release dates to throw into On This Date, and I thought I'd pick up some of the designers' birthdays to put on the calendar, too.  When I was working on that, I noticed the list was gone

interesting

I find it funny that so many things are done at that forum without member's knowledge.
Simple things that could easily be announced.
I mean...why wouldn't you announce "in an effort to thwart spam mailings, we are hiding the members List".
Keep the community informed of the basic things.
(Hide the things that really need to stay hidden)

but they don't.
It feels like many things are secret, or hidden or members only.

Although, Robert explained, the anti-piracy area was kept "members only" to keep out the pirates themselves.
Makes sense.
But that sounds a little bit like the private Mod areas doesn't it?

Apparently now I have members access, but I told Robert that I would not be taking part.
